Terms of service

01Acceptance of terms

By accessing SourcingPick or creating an account, you agree to be bound by these terms of service. If you do not accept these terms, you must not use the service.

02Description of the service

SourcingPick is a SaaS platform that connects buyers ("Clients") with manufacturers ("Factories") through three main services: on-demand sourcing, a marketplace of pre-negotiated products, and a certification programme.

SourcingPick acts as a trusted third party and operates a funds-escrow mechanism via a licensed payment provider.

03Accounts and verification

Account creation is free. Each organisation must provide accurate, up-to-date information and complete a verification (KYC) procedure before transacting.

You are responsible for the confidentiality of your credentials. Any activity carried out from your account is presumed to be yours.

04Acceptable use

You may not use SourcingPick for illegal or fraudulent activities, or activities contrary to French and European regulations on international trade, labour law, or intellectual property.

Any circumvention of the escrow mechanism, the certification programme, or our verification tools is strictly prohibited.

05Payments, commissions, and escrow

Funds paid by Clients are collected by our payment provider and held in escrow until the buyer confirms conforming receipt of the goods.

SourcingPick takes a commission on each transaction. The rate depends on the subscribed plan and is disclosed at quote time.

06Intellectual property

All elements of the platform (software, design, trademarks, editorial content) are the exclusive property of SourcingPick or its licensors.

You retain all rights in the content you publish (specifications, photos, documents) and grant SourcingPick a limited licence to use it for operating the service.

07Warranties and limitation of liability

SourcingPick takes all reasonable steps to vet its partner factories but cannot guarantee absolute conformity of manufactured products. The escrow mechanism is designed precisely to protect the buyer in case of non-conformity.

Our liability is limited, to the extent permitted by law, to the amount actually received in respect of the affected transaction.

08Termination

You may terminate your account at any time from your settings. SourcingPick may suspend or terminate an account in case of breach of these terms, after notice.

09Changes to the terms

We may modify these terms to reflect changes in the service or in regulations. Any material change will be notified to you by email at least 30 days before it takes effect.

10Governing law and jurisdiction

These terms are governed by French law. Any dispute shall fall within the exclusive jurisdiction of the courts of the Paris Court of Appeal, subject to mandatory legal provisions to the contrary.
